Wedding Services Agreement This Wedding Services Agreement (“Agreement”) is entered into by and between Fresh Focus LLC, operating under the name Mendocino Photo & Video (“Service Provider”), and the undersigned clients (“Client”), upon submission of the completed booking form and agreement to the terms below. ⸻ 1. Scope of Services Fresh Focus LLC, operating as Mendocino Photo & Video, agrees to provide wedding photography, videography, or a combination of both (“Services”) as outlined in the selected package for the wedding date and location provided in the booking form. Specific details, including the scope of Services, hours of coverage, and included deliverables, are provided in the “Description of Services” section. Any changes to the event schedule, locations, or scope of work must be submitted in writing and approved in advance. ⸻ 2. Payment Terms A non-refundable retainer of 50% of the total package price is required to reserve the date and Services. The remaining balance is due no later than 30 days prior to the wedding date, unless a written payment plan has been arranged. If an installment plan is used, all payments must be made on schedule. Missed or late payments may result in delayed delivery and are subject to a 5% weekly late fee. No deliverables will be provided until the account is paid in full. A 3% processing fee applies to all credit or debit card transactions. This fee is waived for fee-free transfers on platforms such as Venmo, check, or bank transfer. ⸻ 3. Cancellation, Rescheduling & Package Changes If the Client cancels more than 30 days prior to the wedding, the non-refundable retainer is forfeited, and no further balance is due. If cancellation occurs within 30 days, the full package price remains due, as the date is unlikely to be rebooked and preparatory work will have been done. If the Client fails to pay by the due date and no written extension or plan has been agreed upon, the Service Provider may cancel Services and release the date, with no further obligation. The retainer will be retained as liquidated damages. Downgrading packages (e.g., from 8 to 6 hours of coverage) after booking is not permitted. Upgrades (e.g., additional time or services) may be allowed, subject to availability and must be requested in writing. Any exceptions to the above are at the sole discretion of the Service Provider and do not imply entitlement to future adjustments or refunds. If the Service Provider is unable to perform due to illness, injury, acts of God, or other unforeseen circumstances, every effort will be made to secure a qualified replacement. If no substitute is available, all payments will be refunded and the agreement terminated with no further liability. Rescheduling due to force majeure will be accommodated without penalty, subject to availability. ⸻ 4. Audio & Equipment Limitations (for Videography) Audio quality may vary due to venue conditions, DJ equipment, microphone positioning, wind noise, or interference. While every effort is made to capture clean sound, issues may arise from: • Wind (especially near the ocean or outdoors) • Equipment interference or static • Third-party DJ or venue systems • Inaccurate or missing technical information from DJs or venues (e.g., cable types) Where possible, backup audio is recorded using lavaliers, recorders, or camera mics. However, the Service Provider is not liable for poor-quality or missed audio caused by external conditions or uncooperative vendors. ⸻ 5. Delivery Timeline If included in the selected package, the following delivery timelines apply: • Highlight film: 8 to 10 weeks from the wedding date • Additional video edits: 12 to 16 weeks • Still photography gallery: 6 to 10 weeks Timelines begin once the account is paid in full and all required materials (e.g., music preferences, image selections) have been submitted. ⸻ 6. Rush Editing Option Expedited editing and early delivery may be available for an additional fee. Rush requests must be submitted and approved in writing in advance, and availability is not guaranteed. ⸻ 7. On-Site Videography Coverage The Service Provider will be the exclusive professional videographer for the event. Guests and vendors may record casually, so long as they do not interfere with video coverage. The Service Provider may bring an assistant or second shooter at their discretion, unless otherwise included in the purchased package. The number of team members present may vary depending on the scope of coverage booked. ⸻ 8. Copyright & Usage All media — including images, videos, and raw or edited materials — remain the copyrighted intellectual property of the Service Provider. The Client is granted a non-exclusive, royalty-free license to use final deliverables for personal, non-commercial purposes, including sharing with friends and family or posting on social media. The Service Provider retains the right to use media from the event for promotional purposes, including portfolio, website, social media, vendor collaborations, and advertising. If the Client wishes to limit or restrict promotional use, a written request must be submitted prior to the event and may be subject to a privacy fee ranging from $400 to $1000, depending on the scope of restrictions requested. Limited promotional use (e.g., wide-angle or non-identifying shots) may be considered on a case-by-case basis but is not guaranteed. ⸻ 9. Raw Footage & Additional Edits (If Applicable) If purchased, raw footage is delivered “as-is” — unedited, ungraded, and not optimized for public use. Raw files may include camera shake, background noise, or incomplete sequences and are not color corrected or audio balanced. No guarantees are made regarding the completeness of raw material. Edited add-ons (e.g., full ceremony, toasts, extended films) are delivered separately from highlight films and will reflect the Service Provider’s documentary and storytelling style. ⸻ 10. Retouching & Styling Cosmetic retouching — including skin smoothing, body modifications, or styling adjustments — is not included in any deliverables. All media reflects real moments captured naturally, with light editing for color, tone, and clarity. ⸻ 11. Creative Discretion The Client acknowledges that they are hiring the Service Provider for a documentary, cinematic, and emotionally-driven style of storytelling. Editing decisions, including clip selection, pacing, and music, are made at the sole discretion of the Service Provider. Requests to include or exclude specific people or moments must be made prior to the event. Post-delivery content preferences are not guaranteed to be accommodated and may incur additional fees if accepted. ⸻ 12. Revisions One round of minor revisions is included for each edited deliverable. Revision requests must be submitted within 10 days of delivery. Additional revision rounds or significant changes will be billable at a rate determined by the scope of work involved. ⸻ 13. Limitation of Liability In the rare event of total equipment failure, data loss, theft, or other issues beyond the Service Provider’s control, liability is limited to a full refund of all payments made. The Service Provider is not responsible for missed moments caused by guest interference, poor lighting, venue restrictions, or inclement weather. ⸻ 14. Governing Law & Dispute Resolution This Agreement shall be governed by the laws of the State of California. Both parties agree to attempt informal resolution through mediation. If unresolved, disputes will be resolved through binding arbitration in Sonoma County, California. Each party is responsible for their own legal fees. ⸻ 15.
